Criminal Defence

Lisa is usually instructed by the defence team to consider and review Briefs of Evidence prepared by law enforcement agencies or regulatory agencies.  Lisa is also instructed to consider the evidence presented in confiscation proceedings.

These Briefs of Evidence usually claim that the Defendant has benefited from participating in a particular crime and use that information as a basis for the charges laid and / or for the recovery of the alleged benefits obtained.

For criminal matters, Lisa critically examines the basis of the Prosecution’s claims and examines the evidence presented.  Practical advice is given on the strengths and weaknesses on the financial aspects of the Prosecution’s case.  Lisa has been able to provide advice which has led to the retraction of some or all charges in numerous criminal matters.

For confiscation proceedings, it is up to the Defendant to disprove the Prosecution’s case.  Lisa has significant experience in considering the evidence and assumptions presented by the Prosecution in these matters.  It is Lisa’s role to review the financial evidence and consider the validity of assumptions considering the evidence available.  This can involve disproving allegations of hidden assets and showing legitimate sources of income used to purchase assets.

For both criminal and confiscation proceedings, Lisa is then able to prepare a forensic accounting report in plain English, act as an expert witness and provide evidence at committal and trial.  Lisa also has extensive experience assisting at trial, during the cross examination of Prosecution witnesses.

Lisa has assisted Defendants legal representatives in:
  • Showing insufficient evidence has been provided in relation to some or all charges
  • Reducing charge periods due to a lack of evidence
  • Reducing amounts claimed to have been earned as a result of alleged criminal activity
  • Showing that financial pressure was not a motive
  • Showing assets were purchased with legitimate funds
  • Reducing pecuniary penalty orders.
